Terms of use
Last updated: [DATE]
Draft for review. Replace bracketed items and have a lawyer review before publishing.
These terms govern your use of the Sidestage website and app (the "Service"), operated by [Company legal name] ("Sidestage", "we"). By creating an account or using the Service you agree to them.
Who can use Sidestage
You must be at least 18 years old and able to enter a binding agreement. You may only create an account for yourself, or for a band or business you are authorised to represent.
Your content
You keep ownership of everything you upload. By uploading, you give Sidestage a non-exclusive, worldwide licence to host, store, convert, stream and display that content within the Service (including creating short previews) for as long as it remains on your profile. This licence ends when you delete the content or your account, except for copies held briefly in backups.
You confirm that you own your content or have permission to use it, including any recordings, compositions and images of other people. Do not upload commercial recordings you do not own, and do not upload other people's music or photos as your own.
Rules
- Be honest about who you are, what you play and what you offer.
- No harassment, hate, threats, sexual content, or spam. No soliciting for anything other than music-related collaboration and services.
- No scraping, automated swiping, or attempts to access other users' data.
- No uploading malware, or content that infringes anyone's rights.
We may remove content or suspend accounts that break these rules, and we will respond to valid copyright notices under the DMCA. Send notices to hello@sidestagemusic.com. [Register a designated agent with the U.S. Copyright Office and list it here.]
Meeting people
Sidestage introduces people; it does not vet them. Use the same judgment you would with anyone you met online: meet in public places, tell someone where you'll be, and take your time. Any agreement you make with a studio, service or bandmate is between you and them.
Fees
Core features are free. If we introduce paid features, their price and terms will be shown before you buy, and purchases made through Apple or Google are subject to their terms.
Disclaimers and liability
The Service is provided "as is". To the fullest extent permitted by law, Sidestage is not liable for indirect or consequential losses, or for the conduct of any user, and our total liability to you is limited to the amount you paid us in the past twelve months. [Have counsel adapt this section for your jurisdiction.]
Ending your account
You can delete your account at any time from the app. We may suspend or end accounts that violate these terms.
Changes and law
We may update these terms and will give notice of material changes in the app. These terms are governed by the laws of [State], and disputes will be resolved in the courts of [County, State].
